Committee on presidential elections asks Toader to take measures in case of Kovesi's 'misconduct'

The head of the parliamentary committee of inquiry into the presidential elections of 2009, Oana Florea, on Monday sent a letter to Minister of Justice, Tudorel Toader, asking him to take the measures that he considers necessary in the context in which the head of the National Anti-corruption Directorate, Laura Codruta Kovesi, "broke her oath of office" by not showing up to the hearings in Parliament.

"We believe that her refusal to appear before the parliamentary committee of inquiry, as appointed by the Romanian Parliament in exercising its control function, Mrs Laura Codruta Kovesi, DNA chief prosecutor, broke her oath of office, which is also stipulated in the Constitution and the provisions of the Constitutional Court resolution no. 611/2017 on misconduct, according to the provisions of Law no. 303/2004 regarding the status of judges and prosecutors. Therefore, we ask you to take the measures that you consider fit in this situation," reads the letter sent by the MPs to the head of Justice.

The letter also mentions that, under its Decision no. 611/2017, the Constitutional Court of Romania noticed "the obligation that Mrs Laura Codruta Kovesi has to appear before the Romanian Parliament - the special committee of inquiry into the presidential elections of 2009 and provide the requested information or make available the other documents or means of evidence held, which are useful for the committee's activity."

According to the said source, the DNA head has been invited to participate in the committee's meetings several times, but she refused to come. Therefore, Tudorel Toader is asked to intervene "considering that the Minister of Justice has control over the prosecutors, through especially designated prosecutors, and that he is also the one who makes the proposal for the chief-prosecutor of DNA" and also considering the fact that the prosecutors, before taking over their office duties taken swear to observe the Constitution and country laws and meet their duties "with honor, consciousness and in an objective manner."
