The Minister of Justice, Tudorel Toader stated on Monday that an inventory of all Constitutional Court decisions on criminal legal norms will be carried out, and those that haven't been transposed will be adapted in relation to CCR's decisions.
"We considered the two requirements that all Romanians know, the ones requested by the Cooperation and Verification Mechanism (CVM) for Justice and which are only natural. There have been discussions lately about the need to reconcile the criminal legislation and criminal procedural legislation with CCR's decisions. ( ...) Consequently, we will draw an inventory of all CCR decisions with reference to legal criminal norms and criminal procedures, we will see which rules were adjusted in line with the decisions and considerations of the Court and if they are still not transposed, we will propose the originating legislator a bill that will reconcile the criminal legislation and criminal procedures with the Court's decisions, because we know all too well that if within 45 days, we do not harmonize them, while the text is suspended, it subsequently ceases its effects. Now, would it be a good thing for a law to cease its effects or to be declared unconstitutional or should it be adapted in agreement with the constitutional values?! Of course, they have to be adapted, reconciled, " declared Tudorel Toader, the Minister of Justice, with regard to certain projects meant to amend criminal legislation.
