Competition Council sanctions four companies for rigging auctions organized by CNAIR

The Competition Council sanctioned four companies, with fines totaling 2.318 million RON, for rigging auctions organized by the National Road Infrastructure Management Company (CNAIR).

"The Competition Council has sanctioned the companies Tredeco Holding SRL, Trecon Logistic SRL, Data Capture SRL and Geo Drumuri Banat SRL with fines totaling 2,317,896.04 RON (approximately 466,000 euros) for rigging public auctions organized by the National Road Infrastructure Administration Company SA (CNAIR) through DRDP Brasov, DRDP Bucharest, DRDP Constanta and DRDP Timisoara," it is mentioned in a press release from the competition authority.

According to the cited source, Trecon Logistic SRL Arad received a fine of 187,718.84 RON, Tredeco Holding SRL Arad of 1,790,037.69 RON, Data Capture SRL Arad of 229,624.31 RON and Geo Drumuri Banat SRL Caras-Severin of 110,515.20 RON.

The competition authority found, following an investigation, that the four companies coordinated their behavior within seven public procurement procedures for current maintenance works of the national road and motorway network managed by the National Road Infrastructure Management Company (CNAIR SA), through DRDP Brasov, DRDP Bucharest, DRDP Constanta and DRDP Timisoara.

"Basically, the companies submitted their bids following an exchange of competitively sensitive information, the strategy being to divide the market. This strategy led to the restriction of competition on the market for routine maintenance works of the national road and motorway network," the statement states.

The competition law prohibits any agreements between companies and concerted practices that prevent, restrict or distort competition on the Romanian market, especially those that establish purchase or sale prices or any other trading conditions, the competition authority emphasizes.

The decisions of the Competition Council are enforceable, and the fines imposed represent revenues for the state budget. The National Agency for Fiscal Administration (ANAF) implements the decision to sanction the competition authority and executes the fines.
