Draft law: Longer prison sentences for incitement to illicit drug use
The Ministry of Interior organized, on Thursday, a public debate regarding a draft law for the amendment and completion of some normative acts regarding the prevention and combating of trafficking and illicit consumption of drugs and substances with psychoactive effects, told Agerpres.
According to the draft law, inciting a person to the illicit consumption of dangerous drugs, by any means, is punishable by imprisonment from 1 to 3 years, which represents an increase of the minimum sentence which is currently six months' imprisonment.
In the case of high-risk drugs, the prison sentence will be from 1 to 5 years, as well as in the case of advertising any products "plausibly claiming that by consumption they produce effects similar to drugs".
Also, it is introduced as an aggravating circumstance of drug trafficking the commission of the act "in places where public gatherings or cultural-sporting events are taking place, in places specially arranged for fun or leisure", in addition to the current provisions for trafficking in a medical, educational, military institution or unit, in a place of detention, social assistance, re-education center or in a medical-educational institution, in places where pupils, students and young people carry out educational, sports, social activities, as well as near these places and institutions.
It is also desired that in the case of drug trafficking crimes, the special confiscation of the vehicle in which dangerous drugs were discovered or which was used in any way to commit the crime, regardless of the amount of dangerous drugs involved the crime.
