The president of the Permanent Electoral Authority (AEP), Adrian Tutuianu, says that the entire electoral calendar should be shortened in case early elections are called, but that the Government could not adopt the emergency ordinance necessary in this regard.
During a press conference held on Tuesday at the AEP headquarters, Tutuianu emphasized that, according to Article 89 in conjunction with Article 63 of the Constitution, the President can dissolve Parliament, the consequence being the calling of early elections, which must take place within three months at most.
"Law 208/2015, which is the basic normative act, was designed for elections on time. The entire electoral calendar, including the deadlines within which certain procedural aspects must be resolved, were designed based on the idea of an election that normally takes place on time. Such a calendar, as the one provided for by Law 208/2015, is today impossible to respect in the context of early elections, because, on the one hand, we would have to shorten the deadlines a lot," Tutuianu said.
He mentioned that shortening the deadlines implies the adoption of a normative act, but Parliament is not currently working, and the Government cannot adopt emergency ordinances. At the same time, at least five government decisions would be necessary.
According to the AEP president, the establishment of constituency electoral bureaus and polling station electoral bureaus should be done in "much shorter" terms, which raises the issue of access to justice and the ability of the courts to resolve any appeals in a very short time.
He expressed this point of view following an analysis of the regulatory framework, developed in the context of discussions regarding early elections.
"The President told us that he is still looking for a solution to achieve a parliamentary majority, to avoid early elections and to ensure governance. Beyond that, the Permanent Electoral Authority has some legal responsibilities, which is why I presented to my colleagues and finalized the analysis of the existing regulatory framework to day, in the context in which we have seen positions, including from some parliamentarians, who say that everything is ok, elections can be organized at any time", stated the AEP president.
