The Constitutional Court of Romania (CCR) has argued that amendments to the National Integrity Agency (ANI) law regarding a three-year statute of limitation on conflict of interest are deficient in terms of legislative technique.
CCR on Tuesday ruled unconstitutional the amendments to the ANI Law that would have set a three-year statute of limitation on conflicts of interest.
"Following deliberations, the Constitutional Court has unanimously upheld the constitutionality objection and found the provisions of the law supplementing Law 176/2010 on integrity in the exercise of public office and dignity, amending and completing Law 144 / 2007 on the establishment, organisation and operation of the National Integrity Agency to be unconstitutional. In order to agree on this solution, the court has found in essence that the criticised provisions are deficient in terms of legislative legal technique, which leads to a violation of the provisions of Article 1 (5) of the Constitution as regards the quality of the law," CCR says in a press statement.
On August 2, President Klaus Iohannis filed a constitutionality objection with CCR over the law supplementing Law 176/2010 on integrity in the exercise of public office and dignity, amending and completing Law 144 / 2007 on the establishment, organisation and operation of the National Integrity Agency.
