DOCUMENT: Comisia Europeana, reactie intarziata la neregulile de la votul din Diaspora

Comisia Europeana a formulat un raspuns la o sesizare a unui europarlamentar roman privind neregulile de la votul din Diaspora, la doua luni dupa ce a fost sesizata.

Europarlamentarul Cristian Preda a sesizat CE pe data de 10 noiembrie, intre cele doua tururi de scrutin, privind problemele intampinate de romanii din Diaspora la votul din primul tur al alegerilor prezidentiale. El vorbeste despre cozile interminabile, despre numarul redus de sectii de votare si despre refuzul autoritatilor romane de a suplimenta numarul sectiilor de votare in turul al doilea, in ciuda legislatiei interne care ar fi permis acest lucru.

Cristian Preda cerea in acel context o interventie politica a CE, un semnal de alarma dat Guvernului pentru a respecta normele internationale de organizare a alegerilor si de asigurare a accesului la vot a tuturor cetatenilor cu acest drept.

Iata scrisoarea lui Cristian Preda catre presedintele CE:

„Bucharest, November 10th 2014

Dear President Juncker ,

I am writing to inform you about the circumstances arising from the first round of Presidential Elections that were held in Romania on November 2nd, 2014.

Romanian citizens residing abroad - over 3 million people - have been prevented from voting. In exercising this fundamental political right, they have encountered numerous obstacles such us: an insufficient number of polling stations, not being allowed to vote electronically, massive queuing and blockages during the vote, the refusal of Romanian Embassies to extend the voting hours despite the sizeable queues outside of the polling stations. Overall, less than 200.000 Romanians residing abroad were able to vote on November 2nd and they are now asking for the opening of new polling stations.

The Ministry of Foreign Affairs has refused to open additional polling stations, although this is legal under Romanian Law. I would also like to mention that in several EU Member States the local mayors have offered logistical support, by making available buildings, for opening up new polling stations, but the Ministry of Foreign Affairs has consistently refused to do so.

This situation has led to widespread protests in Romania during the weekend, whereby citizens were asking for the right to vote to be respected for all Romanians, both at country level and abroad.

I trust that you will agree with me that this unique situation is unacceptable. The Foreign Affairs Minister, Mr. Titus Corlățean, has ultimately resigned today over the refusal of his Ministry to open new polling stations abroad, which is also an indication of the gravity of the situation.

I would like to emphasize that international electoral standards have been violated, in particular article 25 of the International Covenant on Civil and Political rights of 16 December 1966, entered into force on 20 November 1974, which recognizes the right of every citizen to vote in "genuine periodic elections which shall be by universal and equal suffrage and shall be held by secret ballot, guaranteeing the free expression of the will of the electors". This article is observed by all EU and OSCE electoral observation missions in every country where such missions are sent.

I would therefore like to urge you to ask the Romanian Prime Minister, Mr. Victor Ponta, to respect the applicable international electoral standards and ensure that the right to vote of each and every Romanian citizen is respected in the second round of Presidential elections that are due to take place on November 16th.

Asa cum spune parlamentarul raspunsul a venit doua luni mai tarziu si a fost unul "dezamagitor".

"Am primit răspuns la scrisoare abia vineri seara, după aproape 2 luni de așteptare. Răspunsul - redactat de prim vicepreședintele Timmermans - e politicos, dar dezamăgitor: Eu îi ceream președintelui Comisiei o intervenție politică de urgență, pentru a-i reaminti lui Victor Ponta standardele internaționale în materie de alegeri, nu așteptam o reamenajare a atribuțiilor Comisiei Europene. Nu vreau să-mi închipiui ce s-ar fi întâmplat dacă dottore ar fi reușit să câștige...", scrie Cristian Preda pe pagina sa de Facebook.

Documentul de mai sus prezinta raspunsul CE la sesizarea europarlamentarului, care in ciuda faptului ca subliniaza importanta dreptului la vot si a posibilitatii de a vota, precizeaza ca CE nu poate interveni, ca organizarea alegerilor tine de prerogativele exclusive ale autoritatilor interne ale statelor membre iar sanctiunile pentru eventuale nereguli trebuie aplicate de Justitia din tara respectiva.
