Justice Minister Radu Marinescu stated on Monday that the working group established at the Government aims to analyze the Justice Laws, to see if their application generates systemic dysfunctions.
"The Government's working group aims to analyze the application of the Justice Laws, to see if their application generates systemic, structural dysfunctions, because there may be specific issues, perhaps legitimate dissatisfactions of magistrates, because the magistracy system is ultimately a competitive system, even in certain aspects. (...) If we identify those structural problems that arise from the law and not from misunderstandings between magistrates, then we must intervene. This is the role of this working group, and the Ministry of Justice will do everything within its legal powers, on a fully evaluated factual basis, to achieve the modernization of justice," declared Radu Marinescu, in Parliament.
The Committee for the Analysis and Revision of Legislation in the Field of Justice is composed of representatives of the Prime Minister's Chancellery and representatives of the Ministry of Justice, as permanent members.
The Prime Minister's decision regarding the establishment, organization and attributions of the Committee was published in the Official Gazette.
"The Committee for the Analysis and Revision of Legislation in the Field of Justice, hereinafter referred to as the Committee, is hereby established, a body without legal personality, with an advisory character. The Committee is headed by the representative of the Prime Minister's Chancellery, who has the quality of chairman," the decision states.
The Committee is composed of representatives of the Prime Minister's Chancellery and representatives of the Ministry of Justice, as permanent members.
Representatives of other public authorities and institutions, civil society and international organizations may participate in the Committee's work, upon the invitation of the Prime Minister.
In order to fulfill its duties, thematic working groups may be established within the Committee, at a technical level, composed of experts from the Prime Minister's Chancellery and the Ministry of Justice, as well as experts from institutions or who have the quality of guests, designated for this purpose, it is mentioned in the document.
Representatives of other relevant public and private law entities, from the country and abroad, may participate, as guests, in the meetings of the Committee or of the thematic working groups at the technical level.
Committee members will be able to be assisted during meetings by specialists from the institutions represented.
The Committee has the following main responsibilities:
* analyzes the effects of the implementation of the legislation in the field of Justice adopted in 2022, namely Law 303/2022 on the status of judges and prosecutors, with subsequent amendments and completions, Law 304/2022 on judicial organization, with subsequent amendments, and Law 305/2022 on the Superior Council of Magistracy, as well as any other relevant acts for the implementation of the act of justice;
* analyzes and debates the opinions formulated by the representative associations of judges and prosecutors, as well as by non-governmental organizations regarding the organization and functioning of the Justice and the implementation of the act of justice;
* organizes meetings with representatives of institutions, authorities and organizations, including at international level, with competences or activity in the field of Justice;
* requests points of view from institutions, authorities and organizations, including at the international level, with competences or activity in the field of Justice;
* presents progress reports on the status of the implementation of measures and the exercise of duties;
* proposes a series of measures to ensure the impartiality, independence and efficiency of the judicial act, in accordance with constitutional values ??and international standards regarding the rule of law.
The Committee meets whenever necessary, at the request of the representative of the Prime Minister's Chancellery.
The Committee meetings can be held in person or online and are chaired by the representative of the Prime Minister's Chancellery or by a person designated by him.
The committee adopts recommendations by consensus of its members. In the absence of consensus, the options identified will be transmitted to the Prime Minister based on a comparative analysis.
The adopted recommendations are communicated to the competent authorities in order to initiate draft normative acts or administrative measures necessary for their implementation.
Public communication on behalf of the Committee is carried out exclusively by the Prime Minister or by persons designated by him, the decision published on Friday evening in the Official Gazette also states.
The decision to establish the Committee came following revelations made by a series of magistrates in a material produced by the Recorder on ''Captured Justice''.
