ANRE,ANAF conclude collaboration protocol to strengthen monitoring of energy markets and increase economic discipline

The National Energy Regulatory Authority (ANRE) and the National Fiscal Administration Agency (ANAF) have concluded a Collaboration Protocol that establishes the framework for bilateral cooperation and exchange of information regarding economic operators operating in the electricity, thermal energy, natural gas and hydrogen sectors, according to a press release.

The Protocol aims to improve the supervision and monitoring of the functioning of energy markets and ensure compliance by economic operators with the obligations under national legislation (primary and secondary) and European Union norms.

According to the press release, the parties will promptly identify and address situations of non-compliance with the legislation in their areas of competence and will support investigation and control activities. Requests for information will include the subject matter, purpose, justification, deadline and method of transmission.

Cooperation includes, but is not limited to: exchanges of information, documents and data relevant to the activities of ANRE and ANAF, respecting the principle of confidentiality; the establishment of joint teams of specialists, when necessary, to achieve the objectives of the Protocol; the transmission to ANAF of data regarding the authorizations and licenses issued by ANRE, according to a reporting model provided for in the annex, an integral part of the Protocol.

The document has a duration of 2 years and is automatically extended for successive periods, if neither party notifies termination, at least 30 days before expiration.

According to the cited source, in applying the Protocol, the parties comply with the Fiscal Procedure Code (fiscal secrecy), Regulation (EU) 2016/679 (GDPR) and the legal rules regarding commercially sensitive information. The information is used exclusively for the purpose for which it was requested, and confidential documents are marked as such and treated accordingly. In the event of security incidents, the parties shall be notified immediately, including to the supervisory authority, in accordance with the GDPR.

ANRE and ANAF may agree on additional measures for the protection and security of the data provided and monitor their compliance, within the limits of their legal competences. Subsequent modifications to the Protocol are made by additional act, signed and registered by both parties.
