Court denies motion against Euroepan Commission's Timmermans

Romania's Supreme Court's Justice Crime Investigation Division (SIIJ) has ordered the closing of a case that targeted, among others, First Vice-President of the European Commission Frans Timmermans.

"The Justice Criminal Investigation Division of the Prosecutor's Office attached with the Supreme Court of Justice on March 27, 2019, ordered closed a criminal case generically called 'Timmermans' involving the offence of abuse of office, as described by Article 297 in Romania's Criminal Code, misrepresentations, as described by Article 321 in the Criminal Code, the communication of false information, as described by Article 404 in the Criminal Code, and the creation of an organised crime group, as described by Article 367 in the Criminal Code, since it has been established that no evidence has been produced that would have led to the reasonable assumption that the alleged facts existed in their materiality," according to a court's press statement.

In January, the Lumea Justitiei (Luju.ro) filed a complaint against Frans Timmermans, European Commissioner Vera Jourova, Head of the EC Representation in Romania Angela Cristea, and Attorney General Augustin Lazar for the alleged creation of an organised crime group, abuse of office, misinterpretations, communication of false information all related to an alleged falsification of a report on Romania's progress under the Co-operation and Verification Mechanism (CVM).

The Luju.ro complaint said that the report was drawn up by distorting facts or circumstances by failing to insert essential data and circumstances directly related to the CVM objectives and the use of criminal techniques distorting the reality and the truth about the state of justice in Romania, in order to use the report against the interests of the Romanian state.
