Energy employers call on president not to promulgate law with retroactively applicable obligations

The Employers' Organisation of Producers of Energy from Renewable Sources in Romania (PATRES) is calling on President Iohannis not to promulgate a law approving Government Emergency Ordinance 32/2024 passed last week in Parliament.

The request is determined by the fact that, according to the new amendments in the legislation, the existing prosumers, who own photovoltaic panel systems with installed powers between 10.8 kW and 400 kW, will have to set up storage facilities for the renewable electricity produced.

"The current prosumers have complied with the legislation, they have obtained a connection certificate that guarantees that the distribution network meets the technical conditions to deliver and take over the amount of energy consumed/produced. The new legal provisions passed by the lawmakers come with storage obligations including for the current prosumers, and most of them have resorted to financial support from AFM for the installation of photovoltaic panels. What happens to those prosumers who cannot afford to buy storage batteries, in the absence of a support scheme?".

PATRES says that from a legal point of view, the measure is retroactive - the prosumers who built in the last 3 years did not take this measure into account.

PATRES is composed of 118 member companies, representing energy producers from the entire area of renewables - solar, wind, hydro and biomass - of an installed capacity of approximately 2.5 GW and with investment in the energy system of EUR 3 billion.
