Europarlamentarul Emilian Pavel, scrisoare către liderii UE pe tema protocoalelor din justiţie: Solicită investigaţie a Comisiei LIBE

Eurodeputatul PSD Emilian Pavel semnează o scrisoare deschisă adresată liderilor UE, prin care solicită o investigaţie a Comisiei LIBE din Parlamentul European sau chiar o dezbatere tematică în plen, în privinţa protocoalelor încheiate între SRI şi instituţii din Justiţie.

Emilian Pavel aminteşte în scrisoare şi de faptul că MEDEL, organizaţie a magistraţilor europeni, a adoptat o rezoluţie prin care a condamnat implicarea serviciilor secrete în justiţie.

Demersul lui Pavel vine în contextul în care premierul Viorica Dăncilă urmează să participe la o dezbatere în Parlamentul European, pe tema situaţiei statului de drept din România şi a incidentelor din 10 august din Piaţa Victoriei.

Scrisoarea europarlamentarului Emilian Pavel:

Dear Brigit, Claude and Joe,

I am writing with regards to the critical situation in Romania regarding the unlawful secret protocols between the Romanian Intelligence Service (SRI) and the General Prosecutor’s Office (through DNA - National Anti-Corruption Agency), and the High Court of Cassation and Justice (supposedly). This raises major threats to the Independence of the Judiciary and the Rule of Law in Romania and, respectively, Europe, and I request your help in tackling it at least through a hearing or investigation in the LIBE Committee, or even a thematic debate in Plenary.

Two classified protocols that have been recently discovered and further declassified were concluded between the Romanian Intelligence Service (SRI) and the above-mentioned key institutions that are part of the Romanian judicial authority. This allowed the courts to become a “tactical field” of operations for this intelligence agency (May 25, 2015, Medel), as well as enabled SRI to take part in criminal investigations based on “classified procedures and secret protocols” with prosecutors (May 16, 2016, Medel),

Added to this, the 2nd protocol, between SRI, General Prosecutor’s Office and the High Court of Cassation and Justice, is a forged one. The former president of the High Court of Cassation and Justice, Nicolae Popa, who presumably signed this protocol, has stated that his signature was forged and the date of the signing of the protocol was in fact, one day after he had officially gone in retirement.

On its Council of Administration held in Brussels on May 25th 2018, MEDEL (Magistrats Européens pour la Démocratie et Les Libertés) approved a resolution condemning the interference of the Secret Services in the Romanian Judiciary. They have asked “the Romanian President, Klaus Iohannis, to take a firm public stand in denouncing these protocols and to take concrete steps, as president of Supreme Council of National Defence (CSAT), in ensuring that the intelligence agencies are not interfering anymore with the judiciary process in any way”. MEDEL has also remarked that the EU authorities have been silent on the interference of the Romanian intelligence agencies in the judiciary, since they reduced the analysis of the Romanian judiciary system to the narrow viewpoint of fighting corruption. MEDEL referred to the report made by the Romanian Judges Association on the current threats to the independence of the Romanian judicial system and the Rule of Law. No public statement of the Romanian President has been made on this topic, yet.

As I discussed with Birgit and Joe, I am also sending you a detailed document with the background information on these protocols and the MEDEL Resolution which condemns the collaboration between the Romanian Intelligence Service (SRI) and the prosecutors.

I would really appreciate a hearing in LIBE on this topic as well as a Question with an oral answer with debate on this case, as this situation raises major threats to the Independence of the Judiciary and the Rule of Law in Romania and, respectively, Europe.
