Government approves draft regarding SIIJ dismantlement, competencies to be taken over by regular prosecutors' offices

The Government has approved the draft law regarding the dismantlement of the Section for the Investigation of Judicial Crimes (SIIJ), the competencies to be taken over by regular Prosecutors' Offices, announced, on Monday, the Government's spokersperson, Dan Carbunaru.

"Among the main regulations: the competencies of the SIIJ will be taken over by regular Prosecutors' Offices, the cases to be instrumented by prosecutors designated for them. The cases currently being solved at the level of this Department will be sent administratively, within 60 working days starting with the day of the law's entry into force, through the care of the Prosecutor's Office attached to the High Court of Cassation and Justice, to the competent Prosecutor's Offices, which will continue to solve them, with those solved, currently in the Department's archive, to be sent within 180 days since the entry into force of the law," said Dan Carbunaru at the end of the Government sitting.

"Starting with the date of dismantlement of the Department, the prosecutors employed there, including those with leadership positions, return to the Prosecutor's Offices where they came from or those where they were promoted in the conditions of the law regarding the activity of the Department," said Carbunaru.

According to him, the competencies of the SIIJ will be taken over by the Department for Criminal Investigation and Forensics of the Prosecutor's Office attached to the High Court of Cassation and Justice for crimes committed by judges and prosecutors which are members of the Superior Council of Magistracy, by judges of the High Court of Cassation and Justice and prosecutors with the Prosecutor's Office attached to the High Court of Cassation and Justice, by the judges of the Appeals' Court and Military Appeals' Court, as well as the prosecutors' in the Prosecutor's Offices attached to these courts, Agerpres.ro informs.

Furthermore, Prosecutors' Offices attached to Courts of Appeal will take over the cases regarding crimes committed by judges in Courthouses, Tribunals and Military Tribunals, he said.

"Through the decision today, both the Government, as well as the Ministry of Justice restate their determination to complete all the necessary procedures in their competence to respect the March 31 deadline provided in the governing programme for the abolition of the SIIJ," Carbunaru also said.
