President Nicusor Dan promulgated, on Wednesday, the law by which two or more administrative-territorial units and/or higher education institutions have the right to associate by forming a private sports club with legal personality.
The normative act amends and supplements the Law on Physical Education and Sports No. 69/2000.
The law stipulates that "administrative-territorial units, by decision of the deliberative authorities of the local public administration, as well as higher education institutions, may also be associated within the sports structures of private law associations".
Private, non-profit sports clubs are non-profit legal entities, established, under the conditions of the law, as mono- or poly-sports structures. Two or more administrative-territorial units and/or higher education institutions have the right to associate by forming a private sports club with legal personality, stipulates the normative act.
According to the law, by decision of the deliberative authorities of the local public administration, amounts from the local budget may be allocated for "financing the sports programs of private law sports clubs established within the administrative-territorial unit, established as legal entities without patrimonial purpose, holders of the sports identity certificate, including private law sports clubs established from one or more administrative-territorial units or higher education institutions, sports clubs in which one of the associated members may even be the financing administrative-territorial unit".
Private sports clubs established according to this initiative must comply with the conditions provided for by Law No. 296/2023 on certain fiscal-budgetary measures to ensure Romania's long-term financial sustainability.
