The Constitutional Court of Romania (CCR) decided on Tuesday that some provisions of the amendments to the Law 303/2004 on the status of judges and prosecutors are unconstitutional, announced CCR President Valer Dorneanu.
He said that objections that referred mainly on the magistrates' responsibility were admitted. "We succeeded in pronouncing on the law on the status of magistrates and prosecutors. (...) The solutions were to reject as inadmissible the texts that will be specified in the releases and which refer to the lack of motivation of criticism in particular. We have admitted a series of criticisms regarding several texts in the law. (...) Some of these criticisms, especially concerning magistrates' accountability, have been admitted and we have called for the redefinition of judicial error, bad faith and serious malpractice. The other texts for which we have admitted the objection of unconstitutionality are provided in the releases. For another series of texts we rejected the criticisms as unfounded," said the CCR head.
