The Bucharest Tribunal admitted on Friday the National Anti-corruption Directorate (DNA)'s request that for a 60-day period, the preventive measure consisting in the interdiction of the initiation procedure of dissolution or liquidation of the legal entity SC Tel Drum SA be taken.
National Anti-corruption Directorate (DNA) prosecutors requested that the Bucharest Tribunal take, for a 60-day period, the preventive measure consisting in the interdiction of the initiation procedure of dissolution or liquidation of the legal entity SC Tel Drum SA or, where necessary, the suspension of these procedures.
"Prosecutors with the National Anti-corruption Directorate - the Criminal Judicial Division requested that the Bucharest Tribunal take, for a 60-day interval, the preventive measure that consists in forbidding the initiation procedure of dissolution or liquidation of the legal entity SC Tel Drum SA or, as the case may be, the suspension of these procedures, in a situation where, at the date of the present request trial, these had already been initialised," a DNA press release sent to AGERPRES on Thursday informs.
The anti-corruption prosecutors show that SC Tel Drum SA was prosecuted, as legal entity, for perpetrating the offense of using or presenting, in bad faith, of documents or false, incomplete or inaccurate statements, if the offense results in unlawfully obtaining European funds, with extremely serious consequences, on 27 December 2017.
Moreover, DNA records that in a separate case still in its criminal investigation stage, criminal investigation was initiated in relation to SC Tel Drum SA, having the quality of suspect in committing the criminal offense of: constituting an organised crime group, tax evasion in continued form, complicity to two criminal offenses of abuse of office the obtainment of ill-gotten benefits for self or others.
"On 17 January, SC Tel Drum SA was informed, through the present, the quality of suspect and the disposal of protective orders in this case. Still on 17 January, before the Teleorman Tribunal was recorded the request of Tel Drum SA Alexandria debtor to open the insolvency procedure, the request having 29 January as dead-line," the investigators mention.
The quoted source specifies that the prosecutors' request addressed to the Bucharest Tribunal was formulated on the ground that SC Tel Drum SA had already solicited the launch of the insolvency procedure, a fact that creates the risk of liquidation and cancellation of the defendant legal entity, so that the latter can no longer be criminally held responsible.
"Therefore, the requested measure is considered to be necessary for the smooth running of the criminal process," DNA further shows.
