Draft law on expanding definition of crime of bribery of foreign public officials, approved by Government

The Government approved on Thursday a draft law aimed at further aligning the national regulatory framework with the provisions and principles of the Anti-Bribery Convention, to which Romania acceded in 2023.

According to a press release from the Executive, the draft law was approved to amend and supplement Law No. 319/2024 on establishing measures for the implementation of the Convention on Combating Bribery of Foreign Public Officials in International Business Transactions, adopted in Paris on November 21, 1997, as well as to supplement Law No. 302/2004 on international judicial cooperation in criminal matters, republished, with subsequent amendments and supplements.

The approved draft law aims to further align the national regulatory framework with the provisions and principles of the Anti-Bribery Convention, to which Romania acceded in 2023. The Government thus responds to the recommendations of the Working Group on Bribery (WGB) of the Organization for Economic Cooperation and Development (OECD).

"The main amendments refer to the expansion of the definition of the crime of bribery of foreign public officials, the updating of the sanctions regime, the assignment of the competence of the National Anticorruption Directorate to carry out criminal prosecution regarding certain crimes correlated with the crime of bribery of foreign public officials," the press release states.

At the same time, aspects related to the transfer of criminal proceedings in cases of refusal of extradition, as well as certain special cases of granting international legal assistance, are regulated.

The current initiative is part of the steps included in the process of Romania's accession to the OECD by 2026.

The draft law approved by the Government will be submitted to Parliament for debate and approval.
