The Government approved on Thursday, by ordinance, the modification and completion of some normative acts in the railway field in order to improve the safety of railway transport.
Thus, the amendment of Emergency Ordinance No. 12/1998 regarding transport on Romanian railways and the reorganization of the National Company of Romanian Railways, republished, with subsequent amendments and completions, was approved, in order to:
- establishing the regulatory framework at the primary level that would allow the development of norms regarding the verification and detection of alcohol or psychoactive substance consumption, as well as establishing contraventions and sanctioning alcohol consumption in the case of personnel with responsibilities regarding traffic safety in rail and metro transport found to be below the limit provided for by the provisions of the Criminal Code, as well as norms regarding the collection, storage and transport of biological samples in order to establish the alcohol content in the blood or the presence of psychoactive substances in the body;
- introducing the definition of tram-train transport;
- establishing the competence of the Ministry of Transport and Infrastructure to develop and approve mandatory norms and regulations applicable to tram-train transport, in order to ensure a clear, coherent and predictable legal framework.
At the same time, the amendment of Law No. 202/2016 on the integration of the Romanian railway system into the single European railway area was approved, with subsequent amendments and completions, to rectify the transposition of an article of Directive 2012/34/EU of the European Parliament and of the Council of 21 November 2012 on the establishment of the single European railway area, regarding the possibility of outsourcing some functions of the railway infrastructure manager by the latter.
Also, the amendment of GEO No. 107/2022 was approved to amend and supplement GEO No. 12/1998, in order to eliminate legislative overlaps with other normative acts regulating the field of railway transport.
