Gov't to adopt framework for Anti-Bribery Convention implementation, a pledge of Romania's OECD membership bid

The government is set to approve at its meeting this Thursday a bill for the implementation of the Anti-Bribery Convention, a goal pledged as part of its OECD accession process, and which establishes the crime of bribing foreign public officials, Prime Minister Marcel Ciolacu announced.

"Today we implement the Anti-Bribery Convention, an essential commitment undertaken by Romania last year as part of its bid for OECD membership. We are now aligning the national legislation with the provisions of this convention. The bill to be adopted establishes the crime of bribing foreign public officials," Ciolacu said at the beginning of the government meeting.

In Article 3 paragraph (1), the draft law subject to government approval criminalizes "the deed of a person who, directly or indirectly, promises, offers or gives a foreign public official - for self or for another - undue money or other benefits in connection with the fulfillment, non-fulfillment, urgency or delay in the fulfillment of an act that is part of the job duties of the respective foreign public official, or in connection with the fulfillment of an act that runs counter to these duties, if the deed is likely to procure for the perpetrator or someone else, money or other benefits, or to maintain such advantages in connection with the conduct of international economic operations."
