JusMin sends President Nicusor Dan proposals for heads of major prosecutor's offices

On Tuesday, the Minister of Justice, Radu Marinescu, sent President Nicusor Dan the proposals for the heads of the major prosecutor's offices.

According to a press release from the Ministry of Public Affairs sent to AGERPRES, Radu Marinescu submitted to the President of Romania the proposals for appointments to management positions within the Public Ministry, namely:

* Cristina Chiriac - for the position of Prosecutor General of the Prosecutor's Office attached to the High Court of Cassation and Justice;

* Marius Voineag - for the position of deputy prosecutor of the prosecutor general of the Prosecutor's Office attached to the High Court of Cassation and Justice;

* Ioan-Viorel Cerbu - for the position of Chief Prosecutor of the National Anticorruption Directorate;

* Marinela Minca - for the position of Deputy Chief Prosecutor of the National Anticorruption Directorate;

* Marius-Ionel Stefan - for the position of Deputy Chief Prosecutor of the National Anticorruption Directorate;

* Codrin-Horatiu Miron - for the position of Chief Prosecutor of the Directorate for the Investigation of Organized Crime and Terrorism;

* Alex-Florin Florenta - for the position of Deputy Chief Prosecutor of the Directorate for the Investigation of Organized Crime and Terrorism;

* Gill-Julien Grigore-Iacobici - for the position of Deputy Chief Prosecutor of the Directorate for the Investigation of Organized Crime and Terrorism.

Radu Marinescu also presented a series of arguments for which he decided to move forward with the three proposals that received a negative opinion from the Prosecutors' Section of the Superior Council of Magistracy - Cristina Chiriac, Marinela Mincă and Gil-Julien Grigore-Iacobici.

* Regarding prosecutor Cristina Chiriac, the Minister of Justice says that the management project explicitly highlighted "a systemic approach" of the Public Ministry, taking into account both specialized structures and non-specialized prosecutor's offices, with the identification of real dysfunctions and concrete directions for intervention.

"The candidate detailed how the proposed objectives derive from the professional experience accumulated at the level of non-specialized prosecutors' offices, DIICOT and DNA, demonstrating an applied knowledge of the functioning mechanisms and real needs of the system. At the same time, the correlation between the strategic vision and the operational measures was clearly highlighted by proposing concrete coordination, monitoring and efficiency tools, which confirms that the directions of action are not formulated abstractly, but result from a real and in-depth analysis of the institutional context. Therefore, the claim that the candidate does not know the realities of the Public Ministry is not objectively confirmed, being contradicted by the content of the project and the clarifications provided during the interview," Radu Marinescu points out.

* Regarding Marinela Minca, the minister specifies that the Prosecutors' Section's observation regarding the alleged lack of concrete knowledge of the DNA's realities "does not reflect the entire management project and its experience."

"The project demonstrates clear and in-depth knowledge of the operational flows, institutional mechanisms and structural vulnerabilities of the National Anticorruption Directorate. The professional experience gained, including in management positions, ensures the ability to identify and manage the operational realities of the DNA. The SWOT analysis included in the project identifies persistent risks - staff overload, resource fluctuations, legislative changes - and proposes concrete and implementable measures, reflecting an applied and realistic understanding of the institution. The strategic approach presented by the prosecutor goes beyond simple point descriptions, providing a sustainable operational framework for prioritizing and implementing solutions. Therefore, maintaining the initial proposal for the position of Deputy Chief Prosecutor of the National Anticorruption Directorate is based on the demonstrated competencies, relevant professional experience and capacity to operationalize the managerial vision," Marinescu says.

* In the case of Gill-Julien Grigore-Iacobici, the Minister of Justice mentions that the analysis of the management project and the answers provided during the interview confirmed that he has a solid understanding of DIICOT's strategic priorities and the measures necessary for their implementation.

"Although the Prosecutors' Section assessed that there are 'substantial vulnerabilities' in the project, the observations are largely subjective and do not reflect the way in which the plan was adapted for concrete applicability, a fact demonstrated by the detailed explanations provided during the interview. The prosecutor clarified the structure of the plan, explained how the SWOT analysis correlates with the operational objectives, presented concrete examples of the application of management functions and detailed how the SMART and PCM tools will be used to monitor the activity at all levels. Thus, the project does not represent just a formal structure, but an applicable plan, based on the candidate's managerial and operational experience, which ensures the increase of the Directorate's efficiency in all areas of competence, including priorities related to organized crime, terrorism, human trafficking and economic and financial crimes," emphasizes Radu Marinescu.

The minister also decided to move forward with the proposals in the case of Alex Florenţa and Marius Voineag, without an opinion from the Superior Council of Magistracy.

According to the law, the President of Romania may refuse, with justification, the appointment to management positions, making the reasons for the refusal known to the public.

The presidential decree of appointment or his motivated refusal is issued within a maximum of 60 days from the date of submission of the proposal by the Minister of Justice.
