President Iohannis refers to Parliament Law on Superior Council of Magistracy to be re-examined

President Klaus Iohannis on Friday referred to Parliament, to be re-examined, the piece of legislation that amends and completes Law No. 317/2004 on the Superior Council of Magistracy (CSM). 

"The law for the amendment and completion of Law No. 317/2004 regarding the Superior Council of Magistracy aims at consistent legislative interventions meant to affect the functioning of the Superior Council of Magistracy and its constitutional role, of guarantor of the Justice's independence, the exercise of its mandate as a member of this public authority, as well as the functioning of the Judicial Inspection. Therewith, the draft law sent to promulgation includes contradictory norms, referrals to provisions inexistent in the Law No. 317/2004, provisions that are unclear and/or uncorrelated and even legislative parallelism, which is why the re-examination of this piece of legislation in Parliament is necessary," says the President in his referral.
