CCR's Tanasescu: ICCJ referral on new draft law regarding magistrates' pensions reform postponed to 16 January

President of the Constitutional Court of Romania (CCR) Simina Tanasescu announced on Monday that the referral filed by the High Court of Cassation and Justice (ICCJ) regarding the new draft law of the Bolojan Government on magistrates' pensions reform has been postponed to 16 January due to a lack of quorum, Agerpres reports.

Context At Sunday’s session, the Constitutional Court invoked the lack of quorum after four judges left during a break.

In order for a ruling to be issued, six of the nine constitutional judges needed to be present in the courtroom. The law challenged before the Court changes the way pension amounts are calculated and the conditions under which magistrates can retire.

The draft law had been challenged before the Constitutional Court before, and on October 20 the judges ruled it unconstitutional because it lacked the mandatory opinion of the Superior Council of Magistracy (CSM). Subsequently, the Government assumed responsibility for the bill in Parliament once again, this time with an opinion from the CSM, even though it was a negative one.
