Competition Council fines Thelios SpA 4.55 M lei over anti-competitive practices

The Competition Council has fined Thelios SpA 4.55 million lei (915,068 euros) for participating, along with its partner Shades Originators SRL, in an anti-competitive agreement on the market for luxury eyewear in Romania.

According to a press release from the competition authority, sent to AGERPRES on Friday, it was found that Thelios SpA, the exclusive producer and distributor of luxury products belonging to the LVMH group (Louis Vuitton - Moet & Chandon - Hennessy) in Romania, and Shades Originators SRL, its partner and luxury goods retailer, restricted the online sale of these products, agerpres reports.

"Effectively, through its commercial policy, Thelios SpA prohibited the sale of luxury eyewear via the online store of the retailer Shades Originators SRL. This affected competition by restricting online sales," the press release said.

The Competition Council notes that Shades Originators SRL applied for the leniency policy and reported the anti-competitive practices. As a result, the company benefited from full immunity from the fine.

"Competition law prohibits any agreements between companies or concerted practices that impede, restrict, or distort competition in the Romanian market," the authority stated.

Decisions of the Competition Council are binding, fines imposed constitute revenue for the state budget, and the National Agency for Fiscal Administration (ANAF) enforces the authority's decisions and executes the fines.
