CSM Prosecutors' Section: Gov't seems to permanently implement practice regarding lack of consultation with judiciary

By adopting Government Emergency Ordinance (OUG) No.7/2019 which amends, under a matter of urgency, for the fourth time, the Justice Laws, the Government seems to permanently implement the same practice regarding the lack of consultation with the judicial system, the Prosecutors' Section of the Superior Council of Magistracy (CSM) mentions in an open letter sent to Prime Minister Viorica Dancila.

According to the document, the prosecutors with the CSM see the interinstitutional coordination as essential for streamlining and ensuring a high level of independence and transparency of the judicial system, this representing an area which implies the common effort of all the powers of the state, within the limits of the constitutional and legal duties.

"In our view, the dialogue regarding the adoption of some normative acts should be initiated prior to their issuance. By promoting OUG No.7/2019, which amends, under a matter of urgency, for the fourth time, the Justice Laws, Romania's Government seems to permanently implement the same practice regarding the lack of an institutional dialogue and consultation of the judicial system," the letter mentions.

PM Viorica Dancila invited on Monday, at the Victoria Palace, one representative of each magistrates' associations, as well as representative of the CSM, in order to carry out discussions on the legislation in the justice area.

The Government adopted this ordinance amending the Justice Laws on 19 February.
