The Government approved on Thursday a memorandum on drafting the text of the reciprocity declaration based on which taxable persons from the United Kingdom of Great Britain and Northern Ireland (UK) will benefit from the reimbursement of the VAT they paid in Romania, according to the provisions of the 13th Directive.
According to a press release from the Government, through this memorandum, the Government adopts a declaration of reciprocity, based on which taxable persons from the United Kingdom of Great Britain and Northern Ireland will benefit from the reimbursement of VAT paid in Romania.
"They will be able to benefit from the VAT refund starting from the entry into force of the memorandum, as in the case of the other non-EU states with which Romania has signed reciprocity declarations, such as Turkey, Serbia, Norway and Switzerland. The measure is taken in the context of that the UK is no longer a member of the European Union, and the transition period in which the EU VAT legislation is applicable has ended", the press release states.
From January 1, 2021, the UK has third country status for VAT purposes, including for VAT refunds, except for transactions with goods covered by the Ireland/Northern Ireland Protocol, which is part of The withdrawal agreement, and for which EU VAT legislation continues to apply.
