Draft law on prioritisation criteria for Anghel Saligny programme published in decision-making transparency system

The Ministry of Development, Public Works and Administration (MDLPA) has launched in the decision-making transparency system the drafting process of a Government Decision on setting prioritisation criteria for transfer requests under the national investment programme Anghel Saligny for 2026, Agerpres reports.

The draft normative act aims to establish prioritisation criteria for transfer requests under the Anghel Saligny National Investment Programme for 2026, similar to those approved for 2025 under Government Decision no. 42/2025. The act is issued under the provisions of Article I of Emergency Ordinance no. 87/2025 on budgetary measures for implementing national public works programmes.

The multiannual Anghel Saligny National Investment Programme, financed from the state budget and coordinated by MDLPA, totals RON 65.5 billion, distributed as follows: RON 22.5 billion for water supply and sewage, RON 30 billion for roads and bridges, and RON 13 billion for natural gas distribution, according to the explanatory note.

In 2025, transfers from the state budget for investment objectives under the Anghel Saligny Programme amounted to approximately RON 12.5 billion for all transfer requests submitted by programme beneficiaries, of which around RON 3.5 billion were outstanding requests from 2024. Currently, all transfer requests submitted in 2025 have been fulfilled.

Given that in 2025 transfers from the state budget were made applying the prioritisation criteria approved under Government Decision no. 42/2025, which resulted in fulfilling all registered transfer requests, Emergency Ordinance 87/2025 provides that in 2026 transfers from the state budget to programme beneficiaries will also be made by MDLPA based on prioritisation criteria similar to those approved for 2025, as detailed in this draft act.

According to Article II, paragraph (7) of Emergency Ordinance no. 87/2025, beneficiaries - counties, county seat municipalities, and administrative-territorial subdivisions of Bucharest - that commit in 2026 to a 20% co-financing of the amounts requested in transfer applications submitted to MDLPA, are exempt from prioritisation criteria. The amounts due to them will be reserved from the budget allocated through the 2026 state budget law for the programme. Prioritisation criteria will apply to other categories of programme beneficiaries - communes, towns, municipalities, and intercommunity development associations - unless they voluntarily opt to apply the same legal regime as counties, county seats, and Bucharest sectors.

To apply the criteria to transfer requests, once MDLPA centralises the amounts for which beneficiaries have committed to 20% co-financing, the remaining amounts, representing budgetary credits, are determined from the total budgetary credits approved by the 2026 state budget law.

Based on the progress achieved in implementing the objectives, funds are distributed as follows: 50% for investment objectives with over 80% of the contract value transferred from the state budget; 30% for objectives with 40-80% of the contract value transferred; and 20% for objectives with 0-40% of the contract value transferred.

Within each prioritisation category, requests will be fulfilled in chronological order of registration with MDLPA.

If, prior to transfers from the state budget, the allocated amounts for any category exceed the requests within that category, the surplus can be used monthly for other categories with pending transfer requests, ensuring efficient use of funds.
