Gorghiu: Solutions to justice crisis, inside system, not outside, President,JusMin to participate in a CSM meeting

Former Minister of Justice, Liberal Alina Gorghiu, declared on Monday that solving problems in the justice system lies within the judicial system, not outside it, noting that "a truly constructive step" would be for the president and the Minister of Justice to participate in a plenary session of the Supreme Judicial Council, together with magistrates, for an honest, professional and balanced dialogue, from which real solutions would result.

"In the current context, we are witnessing a crisis in the judicial system. Public statements by political or institutional actors, instead of helping to resolve this crisis, risk deepening it. Exposing internal conflicts in the public space, in the form of contradictory positions or measures taken under the pressure of the moment, fuels people's distrust in a system that should inspire stability, rigor and balance. Justice cannot function like a market, with disputes fought in public and public squabbles," Alina Gorghiu wrote on Facebook.

She pointed out that "the real problems of the system must be discussed and resolved within the institutional framework, through professional dialogue and existing legal mechanisms, until coherent and sustainable solutions are reached, because effectively all the levers exist."

"In this context, today's meeting in Cotroceni between Nicuşor Dan and a small group of magistrates sends an important signal: it is right and necessary that magistrates who report problems in the system be listened to and treated with respect. Dialogue is essential in a state governed by the rule of law. At the same time, however, institutional respect must be equal. Equally, those magistrates who choose to resolve their potential problems within the system, those who do not consider that there are major dysfunctions or those who believe that solutions to the system's problems must be sought through existing institutional mechanisms, must be respected. A mature state does not function by validating a single voice or a single form of expression, but by recognizing the legitimacy of all these approaches," Gorghiu appreciated.

According to Alina Gorghiu, "resolving this crisis cannot be reduced to checking boxes on a form or to formal consultation exercises that only give the impression of dialogue."

"Real crises are not solved administratively, but through genuine institutional commitment and dialogue. I believe that a truly constructive step would be for the President of Romania and the Minister of Justice to participate in a plenary session of the Supreme Judicial Council, together with magistrates, for an honest, professional and balanced dialogue, from which real solutions to improve the problems in the system would result. One thing must be said very clearly: the solutions are within the judicial system, not outside it. We can adopt the best laws in the world and we can modify them whenever necessary. But, if these laws are not applied in good faith, with responsibility and with respect for their spirit, the problems will return every time", Alina Gorghiu also argued.

She added that "true institutional maturity is not seen in spectacular declarations or image competitions, but in the capacity of institutions to manage crises with balance, responsibility and respect for the rule of law."

President Nicusor Dan had discussions on Monday, at Cotroceni, with magistrates who wish to speak openly about the situation in the judiciary.AGERPRES
