Magistrates' associations harshly criticize special pension reform: Violent and irreversible destabilization of judiciary

Four professional associations of magistrates claim that the bill aimed to modify the retirement conditions for judges and prosecutors represents an "irresponsible and constitutionally disloyal attempt to modify" and reject the "constant campaign to denigrate and discredit the judicial system", which aims to "violently and irreversibly destabilize the judiciary".

"The Association of Magistrates of Romania (AMR), the National Union of Judges of Romania (UNJR), the Association of Judges for the Defense of Human Rights (AJADO) and the Association of Prosecutors of Romania (APR) firmly condemn the irresponsible and constitutionally disloyal attempt to modify the retirement conditions of magistrates, through a legislative initiative that, in fact, reflects the state's violation of the obligations assumed towards incumbent magistrates upon entering the profession, masking the inability of political decision-makers to identify and adopt an adequate legislative solution to meet the objectives of Milestone 215 - Component C8 of the PNNR," the magistrates' associations said in a press release.

The magistrates recall that there have been previous projects to modify the retirement conditions, rejected by the Constitutional Court (CCR).

The associations of prosecutors and judges say that, according to the EU's Court of Justice Decision of 5.06.2025, binding for member states, the fact that judges in practice have the guarantee that they will receive, after retirement, a sufficiently high pension "is likely to protect them against the risk of corruption during their period of activity".

The professional associations of magistrates request the judges of the Supreme Court to consider notifying the Constitutional Court for the control of the law before promulgation, and the Superior Council of Magistracy (CSM) to convene the general assemblies of magistrates to debate this bill.

The president of the CSM is also requested to notify the CCR regarding the legal conflict of a constitutional nature between the powers of the state.

The release is signed by judges Andreea Ciuca (AMR), Dana Girbovan (UNJR), Florica Roman (AJADO) and prosecutor Elena Iordache (APR).
