Prosecutors conducting Air Code breach investigation in case of Arad ultralight aircraft crash

The Prosecutor's Office attached to the Timisoara Court of Appeal opened an Air Code breach investigation in the case of the aviation accident that occurred on August 9, when an ultralight aircraft crashed in the yard of the shuttered freight car factory Astra Rail Industries in Arad, killing both occupants on the spot.

Representatives of the Prosecutor's Office attached to the Timisoara Court of Appeal told AGERPRES on Monday that investigations are being conducted into the violation of Art. 112 of Law No. 21/2020 (Air Code) in conjunction with Art. 122.

The prosecutors are considering "the violation by civil aviation personnel of their job duties provided for by the regulatory acts with the force of law, or failure to fulfill such duties, resulting in the endangerment of an aircraft in flight and thereby causing damage or injury to the legitimate rights or interests of an individual or a legal entity."

In connection with Art. 122, this means that the aforementioned offence was followed by the death of one or several persons.

The prosecutors specified that the investigations are being conducted in rem, specifically with regard to the act, not to persons.

The Civil Aviation Safety Investigation and Analysis Authority also announced on its website that "the incident is the subject of a safety investigation," and that the plane involved in the accident was a Zenair CH 601 XL Zodiac registered under the number YR-5078.

The crashed airplane was on a recreational flight, with a seasoned professional pilot from Bucharest at its helm and an 18-year-old boy from Arad as a passenger.
