Tőkés László's trials on "Black March" and hoisting Szeckler, Partium region flags - at ECHR

Two trials of MEP Tőkés László will be tried at the European Court of Human Rights (ECHR) in Strasbourg, the one on "Black March" events (1990) - for crimes against humanity and the one on hoisting the Szeckler flag and of the Partium region, his lawyers announced on Monday.

According to lawyer Menyhárt Gabriella, the "Black March" file was sent to the ECHR in September 2018 to investigate, in addition to murder, also crimes against humanity.

"In a separate letter, I requested in English to the person registering the files to take care of this file, since by working with other lawyers in Transylvania, we have found discrimination in the registration and filtering cases that tend to resolve the Romanian-Hungarian conflicts in Transylvania or abroad. We have asked the person to pay special attention to this very sensitive case, in order to avoid any injustice regarding the filtering and registration of the file", the lawyer told a press conference attended by Tőkés László and lawyer Kincses Előd.

She said that in 2017 a complaint was filed with the Military Prosecutor's Office to investigate and begin the criminal prosecution for murder and deeds against humanity. The first reply, very vague, said that the events had already received sentences in 1990-1991, but the lawyer says that the prosecutor's office did not take into account also the crimes against humanity.

"We have also called for the investigation and prosecution of crimes against humanity in that black March. In response, the prosecutor's office returned through administrative way the complaint, by saying that the events are not described correctly and one cannot conclude what facts we want to be investigated by the Military Prosecutor's Office. Despite the 30 pages we have written. After the second complaint we sent it to the High Court of Cassation and Justice but it was rejected as inadmissible. In September this year, they sent the file to the European Court of Human Rights in Strasbourg," said Menyhárt Gabriella.

The lawyer pointed out that, although there is evidence, there is a great contradiction between the Romanian historical opinion and the Hungarian historical opinion regarding the presentation of those events in March 1990.

"Our real intention is to reach consensus or to show the reality of these events. We have evidence that Ion Iliescu and his companions directed and organized those events in Targu Mures," Menyhárt Gabriella said.

Lawyer Kincses Előd spoke about the trials of the flags hoisted by Tőkés at his Oradea MEP office's balcony, the Szekler one and that of the Partium region, respectively.

"Losing here, at the Oradea courts, the trials related to the flags, we notified the ECHR. It has been registered, but the speed there leaves to be desired. Judges are overloaded and they find any reason to reject immediately registration, without any motivation, the complaints filed. Because it is simply impossible to cope with the load of cases they receive," said Kincses Előd.
