CCR: Law regarding payment of private pensions - unconstitutional

The Constitutional Court of Romania (CCR) has admitted, on Tuesday, the challenges concerning the law on the payment of private pensions, officials of the CCR told AGERPRES.

Judges of the High Court referred the CCR in connection with the draft law on the payment of private pensions under Pillars II and III.

The draft was adopted by Parliament in mid October and stipulates that people who choose to withdraw money from Pillar II - the mandatory privately managed pillar - will initially receive only 30 percent of the amount, with the remainder to be paid in instalments over eight years, and, by exception, patients with oncological conditions may receive the entire amount in a single withdrawal.

Furthermore, people who have a fund smaller than the equivalent of twelve monthly social allowances may also receive the full amount as a single payment.

Judges of the High Court, convened within the United Sections, decided unanimously to notify the Constitutional Court regarding several aspects of unconstitutionality.

According to the magistrates, citizens have the right to a clear, foreseeable and predictable law regarding their pension rights and it is in society's interest for the law to be examined by the Constitutional Court before promulgation, so that any necessary corrections are made before it produces widespread effects.

The magistrates argue that an examination of the law's provisions shows that the criteria of accessibility, clarity, precision and predictability are not met, nor are the principles of legality and proportionality in the regulation of offences and misdemeanours under the law adopted by Parliament.

The Alliance for Romanians' Union (AUR) party also notified the matter to the Constitutional Court, claiming that "the Bolojan Government is stealing Romanians' pensions from Pillars II and III."
