The ownership rights over the apartments in the block affected by the explosion will disappear if the authorities decide to demolish the building, Government spokesperson Ioana Dogioiu said on Thursday.
She mentioned that, currently, there is no legal framework under which the state could reconstruct a demolished building and offer the new apartments to the former owners.
"The moment such a building is destroyed, implicitly the property right is destroyed - I use the legal term, because that's what it's called 'destruction'. So, at that moment, the property right is extinguished because its object is destroyed, it no longer exists. The moment such a block of flats is rebuilt by the state, legally there is no basis for the state to provide the keys," the Government spokesperson stated, in a press conference at Victoria Palace.
Ioana Dogioiu added that the investigation is ongoing, but that, in case of errors, those who caused damage must repair it.
"For now, neither the technical analysis has been completed, nor do we know what will happen to the block. (...) We do not know who is to blame, we do not know if the block will be demolished. Most likely yes, but we do not have a final decision, a final verdict. There have been explosions in Romania before, without a doubt, it is not the first. But this is the first time that the issue of demolishing a block that is so damaged in its structure that it can no longer be repaired is being raised. And hence a number of legal problems," she said.
At the same time, according to the draft ordinance submitted for debate, the reconstruction of the block of flats could be financed from the state budget or by the city hall.
"Regarding how the state can provide these apartments, there is no legal framework. What the state can do - and there is an analysis from this point of view, if it can do it - is to pay the cost of these apartments in the form of compensation, certainly, for those who have insurance and to take over their insurance. Or to grant some aid, on the Brosteni model, for those who had the mandatory insurance policy. But all these elements that I am giving you only as a hypothesis are under analysis at the moment," stated Ioana Dogioiu.
She denied information appearing in the public space according to which the state "wants to become the owner" of the apartments.
"I have seen some headlines in the press that are not factually correct. The state does not want to become the owner of people's houses. The misfortune is that those houses have disappeared and the property right disappears. That is, it is possible that they will disappear, if the block of flats is demolished, and with them the property right. These are legal issues. How they will be carried out to the end and what the final form of this ordinance initiated by the Ministry of Development will be remains to be seen. It is in public debate," stated Ioana Dogioiu.
Ioana Dogioiu specified that, for now, all aid for people affected by the explosion in Rahova is under evaluation at the Government level.
