Justice Minister Tudorel Toader said on Tuesday that in the Centennial Year "the legislator could be generous" regarding the amnesty of certain deeds.
"In the history of criminal law, there were relatively many amnesty-related acts of clemency, possibly related to pardoning as well. Each time the legislator (...) provided for the conditions for amnesty/pardoning, but stipulated the exceptions, that you cannot pardon grave deeds against the person, deeds of domestic violence. Those values must be protected in any socio-economic context and have not enjoyed the legislator's clemency. Now, surely, we are in the Centennial Year and the legislator could be generous from this perspective," Toader said in a show at private TV broadcaster Antena 3.
He said that there is a draft law on amnesty and pardoning in Parliament, but there is no such draft law at the Ministry of Justice.
"In Parliament there has been a draft law on amnesty and pardoning since last year. It is about a political will, it is a legal decision, it is about a criminal policy that the legislator has full constitutional competence to promote. I cannot substitute the legislator. We will see whether this is the way to go. At the Ministry of Justice there is no debate on any normative draft law on amnesty and pardoning," Toader said.
