President Nicusor Dan on Friday promulgated the law that modifies the sanctions in the field of pyrotechnic materials, establishing, among other things, prison sentences from one to five years for the preparation, production, experimentation, possession, transmission in any form, storage, destruction, marketing, use of such items in the entertainment field or other types of such pyrotechnic materials of low, medium and high risk, carried out without approval.
The normative act modifies Law no. 126/1995 on the regime of explosive materials.
The law stipulates that persons who have reached the age of 16 may only possess and use pyrotechnic items from the category F1 (entertainment pyrotechnic items that present a very low risk and a negligible noise level and that are intended for use in confined spaces).
Also, pyrotechnic articles in the category P1 (other than low-risk pyrotechnic materials meant for entertainment and use on stage) intended for vehicles, including airbags and seat belt pretensioners, will be made available to individuals only when integrated into a vehicle or in a removable part of a vehicle.
The regulatory act stipulates that it will be considered a crime and will be punished with imprisonment from three months to one year or a fine to sell pyrotechnic articles in the category F1 to persons under the age of 16, to unauthorized natural or legal persons, to prepare or store these articles without authorization, as well as to exceed the maximum storage quantity of authorized pyrotechnic article warehouses by more than 25%.
It will be a crime and will be punished with imprisonment from one year to 5 years to prepare, produce, experiment, possess, transmit in any form, store, destroy, sell, as well as use pyrotechnic articles from categories F2, F3, F4, T1, T2, P1 and P2, made without approval, respectively for entertainment, stage or other low, medium, high risk articles.
The normative act also stipulates that specially trained personnel will be able to handle explosives for civil use only under the supervision of an authorized pyrotechnician and will be able to handle pyrotechnic articles only under the supervision of an authorized pyrotechnician.
