AG Lazar asks judiciary officials for opinion on 2009 presidential election inquiry

Attorney General Augustin Lazar is asking the Supreme Council of Magistrates (CSM) for an opinion on the ongoing parliamentary inquiry into the 2009 presidential election, and also on the need for the Constitutional Court (CCR) to be notified to rule on the existence of legal constitutional conflict between the legislative and the judiciary authorities.

According to a press statement released by the AG Office, Lazar sent a petition to Chairwoman of the Supreme Council of Magistrates (CSM) Mariana Ghena, in connection with requests from the parliamentary committee inquiring into the 2009 presidential election and, implicitly, the legal issue it raises. "Specifically, the opinion of the Supreme Council of Magistrates is being requested as to whether a copy of the case file, where ordered is the closing of a case which statutes of limitation regarding criminal lability have not expired yet, can be sent to the parliamentary committee. At the same time, the attorney general is asking the council to provide its opinion on the for the Constitutional Court (CCR) to be notified to rule on the existence of legal constitutional conflict between the legislative and the judiciary authorities, as provided for in Article 146 (e) in Romania's Constitution," reads the statement.
