The Targu Mures Court of Appeal refused to carry out the European arrest warrant issued by the Prosecutor's Office in Weiden in der Oberpfalz, Germany, against a Turkish citizen who was accused of trafficking in migrants and revoked the provisional measure of judicial control.
"In accordance with Article 107 (1) with reference to Article 98 (2) (e) of Law No 302/2004, republished, on international judicial cooperation in criminal matters, it refuses to carry out the European arrest warrant No 23 Js 10540 / 2017, issued on 21 November 2018 by the Prosecutor's Office in Weiden in der Oberpfalz, Federal Republic of Germany, for the person requested A. B. According to Article 7 of Law 302/2004 republished with reference to Article 242 paragraph 1 of the the Criminal Procedure Code, it revokes the provisional measure of judicial control taken against the requested person A. B. by the criminal sentence of 17 January, 2019 and maintained by the criminal conviction of 8 February, 2019. According to Article 87 of Law 302/2004 republished, court expenses advanced by the state are the responsibility of the state. The fee of the attorney appointed ex officio for the requested person in the amount of 420 lei is paid from the Ministry of Justice funds," the portal of the court shows.
The conclusion may be challenged within 5 days since the ruling of the Prosecutor's Office attached to the Targu Mures Court of Appeal.
The decision of the Targu Mures Court of Appeal came after four consecutive delays, starting in January, and after having requested documents from the Prosecutor's Office attached to the High Court of Cassation and Justice - Directorate for the Investigation of Organized Crime and Terrorism Offenses.
