Gov't regulates method of reintroducing border controls in specific situations

The Government regulated, on Thursday, the mechanism through which border controls could be reintroduced, in specific and temporary situations.

The normative act adopted in the meeting does not reintroduce border controls, but only approves a decision-making mechanism, according to a press release issued by the Government.

"This regulatory act does not reintroduce border controls, but only approves a decision-making mechanism that can be used in specific and temporary situations, for possible cases in which it would be necessary to reintroduce internal border controls, under the conditions of the Schengen Borders Code. This mechanism is based on proposals from national authorities with competences in the field of defense, public order, national security or public health, which would be transmitted, in order to assess the necessity and proportionality of reintroducing internal border controls or extending them," the cited source reports.

The Schengen Borders Code provides for the absence of controls for persons crossing the internal borders of the Member States.

The same document specifies the situations in which Schengen Member States may reintroduce internal border controls, namely when there is a serious threat to public order or internal security.

These include:

* terrorist incidents or threats and threats posed by serious forms of organised crime;

* major public health emergencies;

* an exceptional situation characterised by unauthorised, unexpected and large-scale movements of third-country nationals between Member States;

* major or highly visible international events;

* persistent serious deficiencies in external border controls, which jeopardise the overall functioning of the area.
